FUNCITONS AND DUTIES
I. Functions, tasks and powers of the Department of Science and Technology
Position, function
1. The Department of Science and Technology is a specialized agency under the Provincial People's Committee, performing the function of advising and assisting the Provincial People's Committee in state management of science and technology including: scientific research activities, technology development, innovation; develop scientific and technological potential; standards, measurement, quality; Intellectual Property; application of radiation and radioisotopes; radiation and nuclear safety; Manage and organize the implementation of public service services in the fields within the scope of functions of the Department according to the provisions of law.
2. The Department of Science and Technology has legal status, its own seal and account according to the provisions of Law; Comply with the direction and management of the organization and operations of the Provincial People's Committee according to its authority; At the same time, comply with the direction, inspection, and professional guidance of the Ministry of Science and Technology.
Duties and powers
The duties and powers of the Department of Science and Technology comply with the provisions of Article 2, Circular No. 01/2021/TT-BKHCN dated 01st March 2021 of the Ministry of Science and Technology guiding functions and tasks, rights of specialized science and technology agencies under the Provincial People's Committees at provincial and district levels.
1. Submit to the Provincial People's Committee
a) Draft decisions related to the fields of science, technology and innovation under the scope of management and other documents as assigned by the Provincial People's Committee;
b) Draft development plan in the field of science, technology and innovation; draft programs, schemes, projects, and measures to organize the implementation of tasks in the field of science, technology and innovation in the province under its management;
c) Draft decision on decentralization and authorization of state management tasks in the field of science, technology and innovation to the Department and district-level People's Committee;
d) Draft decision specifying the functions, tasks, powers and organizational structure of the Department; Draft decision stipulating the functions, tasks, powers and organizational structure of branches and public service units under the Department; Draft decision on establishment and regulations on organization and operation of the local Science and Technology Development Fund according to the provisions of law.
d) Draft decision on socialization of public service provision activities in the field of science and technology under the authority of the Provincial People's Committee and according to the decentralization of superior state agencies .
2. Submit to the Chairman of the Provincial People's Committee: Draft documents under the promulgation authority of the Chairman of the Provincial People's Committee as assigned.
3. Guide, inspect and organize the implementation of legal documents, planning, plans, schemes, projects, mechanisms and policies on science, technology and innovation after being issued execute, approvement: information, propaganda, guidance, dissemination, education, monitoring the implementation of local laws on science and technology; Guide departments, branches, district-level People's Committees, and local science and technology organizations on science and technology management.
4. Manage, register, issue, adjust, revoke and extend all types of licenses, certificates, registrations, diplomas and certificates within the scope of assigned functions and tasks according to the provisions of law, according to the assignment, decentralization or authorization of the People's Committee and Chairman of the Provincial People's Committee.
5. Plan and develop proposals for development investment and science and technology expenditure estimates from the annual State budget for local science, technology and creative innovation fields on the basis of estimate synthesizing of departments, branches, district People's Committees and relevant agencies. Monitor and inspect the State budget's using for the province's science, technology and creative innovation fields according to the provisions of the Law on State Budget and the Law on Science and Technology.
6. Regarding management of scientific research, technology development and creative innovation activities
a) Organize the identification, ordering, selection, assign directly, evaluation and acceptance of science and technology tasks; organize the assignment of ownership and use rights of scientific research and technological development results using the State budget.
b) Monitor, inspect and evaluate the implementation process and post-acceptance of science and technology tasks using State budget
c) Receive, organize applications, and evaluate the application effectiveness of implementation of scientific and technological tasks' results which are proposed or placed order by the Provincial People's Committee after being evaluated and accepted;
d) Organize assessment and appraisal of results of implementation of science and technology tasks that do not use the State budget of organizations and individuals in the province according to the provisions of law;
d) Coordinate with local departments, branches and relevant agencies to propose a list of science and technology tasks using national State budget that are inter-sectoral and inter-regional to serve the local socio-economic development;
e) Establishment of Science and Technology Consultant Councils according to the provisions of the Law on Science and Technology and decentralization of authority by the People's Committee and Chairman of the Provincial People's Committee;
g) Guide and organize the implementation of creative innovation activities and innovative startups; exploiting and applying technology, commercializing the results of scientific research and technological development, propagating the results of scientific research, technological development and innovation; Mobilize investment resources for scientific research and technology development, creative innovation, and creative innovation startups in the locality;
h) Support organizations and individuals to innovate technology, commercialize the results of scientific research and technology development, technology searching, technology import, invention exploitation, technology decoding and mastering; giving opinions on technology for investment projects; Evaluating technological capacity and developing technology development orientation according to the provisions of law.
7. Regarding the development of science and technology market, science and technology enterprises, science and technology organizations and science and technology potential
a) Organizing surveys and investigations to evaluate the level and technological capacity of enterprises and science and technology organizations; operational capacity of intermediary organizations of the science and technology market; guiding the establishment and development; certify and inspect the operations of science and technology enterprises and science and technology organizations in the local area; synthesize and report to the Ministry of Science and Technology according to regulations;
b) Guide and organize the implementation of mechanisms and policies to encourage and develop technology incubation activities and science and technology business incubation activities in the area; develop and organize the implementation of solutions to support technological innovation; commercialize the results of scientific research and technological development, develop the science and technology market and intermediary organizations of the science and technology market;
c) Organize the registration and inspection of the activities of science and technology organizations, representative offices, branches of science and technology organizations;
d) Guide the implementation of the autonomy mechanism of public science and technology organizations according to the provisions of law; Manage operations of domestic and non-public science and technology organizations under management authority;
d) Guide and manage technology transfer activities in the area, including: technology transfer, technology assessment and appraisal, technology transfer brokerage and consulting; Appraise or give opinions on the scientific and technological basis of investment projects, plans, socio-economic development programs and other local programs and projects according to authority;
c) Propose investment projects to develop local scientific and technological potential according to authority and organize implementation after being approved by competent authorities;
g) Organize and implement mechanisms and policies on the use of individuals operating in scientific and technological activities; training and fostering local science and technology human resources;
8. Researching organization and applying scientific - technical and technological advances; exploit, commercialize, announce and propagate the results of scientific research, scientific research and technological development, creative innovation and other scientific and technological activities; Coordinate the implementation of national science and technology tasks using local state budget.
9. About intellectual property
a) Organize and implement the Intellectual Property Strategy until the year of 2030, tasks and programs belonging to the field of intellectual property within the assigned authority; Implement measures to support the development of industrial property activities; Guidance on industrial property professions for organizations and individuals; manage, build and develop brands using place names and other signs indicating the geographical origin of local products; manage geographical indications when assigned;
b) Guide and support organizations and individuals in carrying out industrial property procedures; preside over and coordinate with relevant agencies to protect industrial property rights and handle violations of industrial property laws;
c) Leading the implementation of measures to disseminate, encourage and promote invention, initiative and creative activities in the locality; organize consideration and approval of initiative recognition created by the State's investment of funds and material and technical means according to the provisions of law;
d) Issuing, re-issuing and revoking the Certificate of industrial property appraisal organization according to the provisions of law;
d) Helping the Provincial People's Committee to carry out state management of intellectual property in relevant fields according to the provisions of law and decentralization or authorization of the Provincial People's Committee.
10. Regarding standards, measurement, and quality
a) Organize the establishment and participate in the establishment of local technical standards;
b) Organize the dissemination and application of national technical standards, local technical standards, national standards, international standards, regional standards, foreign standards, and apply conformity assessment methods to technical standards regulations; guidance on building basic standards for organizations and individuals in the area; inspect and examine compliance with laws on standards and technical regulations in the area; Carry out surveys on the quality of local products and goods; Warn about the risk of unsafe products to consumers and local relevant agencies.
c) Organize, manage and guide organizations and individuals to produce and do business; announce standards applying to products, goods, services, processes and the environment as assigned or classified by competent state agencies;
d) Receive and sell standard conformity declarations from organizations and individuals registering production and business activities in the locality; receive and sell declarations of conformity for products and goods that are potentially unsafe (group 2 goods) under management; receive the registration inspection board for the quality of imported goods in the assigned field; Consulting on barcode registration according to assignment and decentralization of competent state agencies; Carry out state management of products and goods ' traceability in locality.
d) Carry out the task of notifying and asking questions about standards, measurement, quality and Rechnical Barriers to Trade (referred to as TBT) in the area; Coordinate with the National TBT Point in handling Q&A information, reviewing documents, drafting local TBT measures, and disseminating information about TBT to businesses to support local exports;
e) Act as the focal point for implementing tasks and programs in the fields of standards, measurement and quality within local authority; Organize a network of inspection, calibration, and measurement testing to meet local requirements; Organize the implementation of inspection, gauging, and measurement testing in registered and designated fields and scopes;
g) Receive the announcement and adjust the content of the using quantitative marks announcement; Announcing the use of quantitative marks and adjusting the content of the announcement on the use of quantity signs on pre-packaged product labels according to the provisions of law;
h) Organize and carry out measurement inspection of measurement standards, measuring instruments, measurements, pre-packaged goods, inspection, calibration, and testing of measurement according to the provisions of law; Organize the implementation of measures for people having related rights and obligations to monitor and inspect the implementation of measurements, measurement methods, measuring instruments, measurement standards, and quality of goods: organize the implementation of the establishment, maintenance, preservation and using local measurement standards;
i) Organize testing tate management requirement serving and the needs of organizations and individuals regarding product and goods quality in the area;
k) Preside and coordinate with relevant agencies to organize quality inspection of products and goods in production, imported goods, goods circulating in the area and goods labels and codes, barcodes as assigned, decentralized or authorized by competent state agencies;
l) Organize and implement the application of the Quality Management System according to the national standard TCVN ISO 9001 in the activities of agencies and organizations in the local state administrative system according to the provisions of law;
m) Guide organizations and businesses to participate in the national and international quality awards; Review and evaluate organizations and businesses participating in national quality awards in the province according to regulations;
n) Organize the implementation of tasks related to improving productivity and quality of products and goods; Being the focal point for implementing tasks under the national program to support businesses in improving productivity and product quality, and the project on tracing the origin of products and goods in the locality;
o) Propagate, disseminate and guide legal documents on quality measurement standards to organizations, individuals and businesses under their management.
11. Regarding applications and radiation and nuclear safety ensuring
a) Organize the implementation of planning, plans, programs, projects and measures to promote the application of radiation and radioactive isotope to serve socio-economic development;
b) Manage environmental radiation monitoring activities in the area; Coordinate management of atomic energy development and application activities according to regulations;
c) Manage public service activities in the field of atomic energy, radiation and nuclear safety in the area;
d) Manage and implement the receipt of declarations, safety appraisal, licensing, amendments, supplements, extensions, and re-issuance of licenses to conduct radiation work using diagnostic X-ray equipment in medicine; issue radiation worker certificates to people who in charge of safety at medical diagnostic X-ray facilities operating in the province according to the assignment, decentralization and authorization of the Provincial People's Committee;
d) Preside and coordinate with relevant agencies to inspect and examine compliance with legal regulations on radiation and nuclear safety in the area of management and handle violations according to authorization
e) Preside and coordinate with relevant agencies to help the Provincial People's Committee develop a plan to respond to radiation and nuclear incidents at the Provincial level and submit to the competent authority for approval and implementation after being approved; handle radiation and nuclear incidents in the area as assigned by the Provincial People's Committee; Receive, notify and coordinate with relevant agencies to verify information and holding searching and handling of radioactive sources, nuclear materials, and nuclear equipment that are out of control;
g) Preside and coordinate with functional units of the Ministry of Science and Technology to collect radioactive waste and radioactive sources discovered in the management area but the owner cannot be identified; Coordinate with functional units of the Ministry of Science and Technology in appraising, licensing and managing radioactive sources in the area according to the provisions of law;
h) Instruct organizations and individuals in the area to manage radioactive waste management measures and used radioactive sources, and carry out measures to ensure safety and security when detecting radioactive sources, nuclear materials, and nuclear equipment are out of control;
i) Build a database on safety control, radiation and nuclear security locally and integrate with the national database on science and technology.
12. About information, science, technology and creative innovation statistics
a) Organize and implement the processing, analysis, synthesis and provision of scientific and technological information, statistical information of science, technology and creative innovation to serve leadership, management and research , training, production, business and local socio-economic development;
b) Organize instructions and implement the collection, registration, storage and publication of information on science and technology tasks within the scope of local management according to regulations;
c) Build and develop scientific and technological information infrastructure; Participate in building, updating and exploiting the National Database on science and technology; Build, manage, connect and share local science and technology databases to ensure synchronous and consistent integration, exchange and sharing of data; Participate in exploiting, maintaining and developing the Vietnam Research and Education Network (VinaREN) and other scientific and technological information networks; applying information and communication technology and advanced technical means in scientific and technological information and statistics activities;
d) The focal point to connect and deploy projects of the Vietnamese Digital Knowledge System locally. Deploying and building local data projects; Develop and integrate local management information and data systems in fields such as education, agriculture, health, science and technology, culture... and share publicly on the System of digitized Vietnamese knowledge for the community to exploit and use;
d) Direct the organization and implementation of statistical reporting regimes for science and technology sectors in the locality;
e) Coordinate and organize the implementation of statistical surveys on science, technology and creative innovation under the National Statistical Survey Program and outside the National Statistical Survey Program at localities: Direct the implementation of local scientific, technological and innovation statistical surveys;
g) Manage, build and develop local science and technology information sources; Participate in the Vietnam Library Consortium on science and technology information sources;
h) Organize technology - equipment markets, technology information centers and exchanges directly and on the Internet, science and technology exhibitions, fairs; disseminate, publish and provide scientific and technological information;
i) Organize service activities in the fields of information, library, statistics, and science and technology databases; printing, digitization; organize science and technology events.
13. Regarding public service:
a) Guide non-business organizations to carry out public non-business services in the field of science and technology in the area;
b) Organize the implementation of processes, procedures, and economic-technical norms for public service provision activities in the field of science and technology;
c) Guide and create conditions to support organizations performing public non-business services on science and technology according to the provisions of law.
14. Manage, encourage, and support the development of businesses, cooperatives, collective economies, and private economies in the field of science and technology operating in the area.
15. Carry out international cooperation in science and technology according to the provisions of law and according to the assignment, decentralization or authorization of the Provincial People's Committee and superior state agencies.
16. Carry out inspection, examination, and resolve complaints and denunciations in the field of science and technology according to the provisions of law and according to the assignment, decentralization or authorization of the People's Committee; organize citizen reception and implement regulations on preventing and combating corruption and negativity, and regulations on practicing thrift and combating waste; Handle according to authority or propose competent authorities to handle violations of law in the field of science and technology according to the provisions of law.
17. 18. Management of organizational structure, civil servant payroll, structure of civil servant ranks, job positions, structure of public employees by professional title and number of people working in Public non-business units under the Department; Implement salary regimes and policies, remuneration regimes, training, fostering, rewards and discipline for civil servants, public employees and employees within the management scope in accordance with the provisions of law and according to assignment or authorization of the Provincial People's Committee.
19. Manage, guide and inspect activities of associations and Non-Governmental Organizations operating in the field of science and technology under local authority according to the provisions of law.

21. Carry out information work, periodic and irregular reports on the implementation of assigned tasks to the Provincial People's Committee and the Ministry of Science and Technology.
22. Perform other tasks assigned by the Provincial People's Committee, Chairman of the Provincial People's Committee and according to the provisions of law.
Organizational structure of the Department of Science and Technology
1. Department leaders include: Director and no more than 03 Deputy Directors.
a) The Director of the Department is a member of the Provincial People's Committee, the head of the Department, responsible to the Provincial People's Committee, Chairman of the Provincial People's Committee and before the law for performing functions and tasks, powers of the Department of Science and Technology and implementation of duties and powers of the Provincial People's Committee member according to the working regulations and assignments of the Provincial People's Committee.

Position, function
1. The Branch of Standards, Metrology and Quality is an organization under the Department of Science and Technology, with the function of advising and assisting the Director of the Department in performing state management in the fields of standards, measurement and quality; Carry out state management tasks and manage public services in the fields of standards, measurement and quality in the province according to the provisions of law.
2. The Branch of Standards, Metrology and Quality has legal status, has its own seal and account, opened at the State Treasury and Banks in the province according to the provisions of law; Under the direction directly and management of the organization, personnel and operations of the Department of Science and Technology, and at the same time subject to direction, inspection and guidance on expertise, standards, measurement, productivity and quality of products and goods of the Directorate for Standards, Metrology and Quality.
Duties and powers
1. 6. Organize, manage and guide production and business organizations and individuals to announce standards applicable to products, goods, services, processes and the environment as assigned , decentralized by competent state agencies.
7. Measurement inspection of measurement standards, measuring instruments, measurements, pre-packaged goods, inspection, calibration, and testing activities on measurement according to the provisions of law; Organize the implementation of measures for people having rights and obligations to monitor and inspect the implementation of measurements, measurement methods, measuring instruments, measurement standards, and quality of goods.
8. Check the quality of products, goods in production, imported goods, goods circulating in the area and goods labels, codes, barcodes as assigned, decentralized or authorized by government agencies competent country.
9. Specialized inspection of standards, measurement, and quality of products and goods in the area according to the assignment and decentralization of competent state agencies.
10. Being the agency that directly helps the Department of Science and Technology to perform the focal point function to unify state management of product and goods quality in Son La province, specifically:
- Preside and coordinate with departments, divisions and branches to set up and implement annual quality inspection plans for products and goods at operations with many products and goods under the management of the Department, many ministries managing industries and fields;
- Inspect and urge departments, divisions and branches to perform state management functions on product and goods quality in assigned and decentralized fields, and annually organize summaries and assessments of operational results of State management with regard to product and goods quality;

14. Organize and deploy the application of the quality management system according to TCVN ISO 9001 to the activities of agencies and organizations under the state administrative system in Son La province according to the decentralization or authorization of the Department's Director.

16. Resolve administrative procedures within the scope of the Branch of Standards, Metrology and Quality.

B. Center for Creative Innovation Start-up Support
Position, function
1. Center for Creative Innovation Start-up Support (hereinafter abbreviated as Center) is a public science and technology unit under the Department of Science and Technology of Son La province, performing information functions, statistics, research, application, deployment, technology transfer, science and technology services to serve the province's state management.
2. The Center has legal status, has its own seal and is allowed to open accounts at the State Treasury and banks to operate in accordance with the law.
Duties and powers
1. Organize and carry out analytical processing, synthesis and provision of scientific and technological information, scientific and technological information and statistics to serve the leadership and state management of the province; Publishing and providing scientific and technological information publications.
2. Organize and carry out propaganda and dissemination of science and technology information, science and technology statistical information of the province; coordinate with mass media agencies to bring scientific knowledge to all audiences; Providing scientific and technological information to serve the development of agriculture, farmers and rural areas.
3. Organize and develop the province's science and technology information sources; Participate in building and exploiting the national database on science and technology; Build and update science and technology databases (collect, update, process and store data, figures and facts about science and technology activities in the province), statistical databases of science and technology of the province; Build and develop library work, electronic libraries, digital libraries, science and technology information network of the province, participate in the Vietnam Library Union on science and technology information sources.
4. Organize events, conferences, and seminars on science and technology; guidance and professional training in science and technology information and statistics; Organize and participate in technology and equipment markets, technology trading floors in the province, domestically and internationally; Guide and inspect the operations of technology trading centers, technology trading floors, and intermediary organizations of the science and technology market in Son La province.
5. Perform scientific and technological information services according to the provisions of Article 12 of Decree 11/2014/ND-CP dated 18th February 2014 of the Government on scientific and technological information activities.
6. Organize the registration and storage of performing results of scientific and technological tasks; Collect, process and update infpormation on ongoing science and technology tasks, application results of science and technology tasks within the province into the national database on science and technology.
7. Provide information to serve the identification, selection, implementation, evaluation and acceptance of scientific and technological tasks and other tasks.
8. Guide and implement statistical reporting regime on science and technology in the province; preside over the implementation of a general statistical reporting regime on science and technology; Organize and expand statistical surveys organized by the Ministry of Science and Technology in the province; Annually build plans to organize surveys, synthesize data on science and technology, apply information technology to build software and manage the science and technology statistical databases of the province.
9. Participate in implementing national and industry statistical surveys on science and technology in the province; preside over the implementation of science and technology surveys in the province.
10. Organize, implement and provide products and services for research, training, production, business and socio-economic development according to society's requirements in the field of information and library, information technology, science and technology statistics and other fields as prescribed by law.
11. Develop information infrastructure, build a database on science and technology; Organize and manage the LAN and WAN network systems of the Department of Science and Technology; Administer the Department's science and technology information portal; Annually develop plans to maintain and upgrade the Department's LAN, WAN and science and technology information portals. 12. Organize research and deploy the application of domestic and foreign scientific and technological achievements in the fields of production, life and environmental protection.

C. Center for Technical Standards for Quality Measurement
Position, function
1. The Center for Technical Standards for Quality Measurement is a self-funded public service unit under the Department of Science and Technology, with the function of providing technical services on standards and measurement, quality of state management serving and needs of organizations and individuals according to the provisions of law
2. The Center for Technical Standards for Quality Measurement endures the leadership and direction of the Director of the Department of Science and Technology and commits to comply with current regulations on technical and non-business activities in the field of quality measurement standards.
3. The Center for Technical Standards for Quality Measurement has legal status, its own seal, its own account and is allowed to open accounts at the State Treasury and Banks in the province to transact according to the law.
Duties and powers
1. Set up programs and activity plans of the Center and submit them to competent authorities for approval and organize the implementation of the plans after approval.
2. Analyze, test, verify and calibrate recognized fields and scopes to serve state management activities and the needs of relevant organizations and individuals.
3. Inspection, certification of standard conformity, certification of regulation conformity, certification of quality management systems for recognized fields.
4. Consulting on building and applying advanced quality management systems to the operations of administrative agencies and businesses in accordance with the recognized scope and in accordance with the provisions of law.
5. Professional training on standards, measurement, and product and goods quality for organizations and individuals in need within the recognized scope and in accordance with the provisions of the law.
6. Research, apply and transfer scientific and technological advances in the field of quality measurement standards when assigned by competent authorities.
7. Organize the implementation of technical service activities on product quality measurement standards and other scientific and technological services within the recognized scope and in accordance with the provisions of law.
8. Joint venture production, business and service provision related to public activities on quality measurement standards and other areas of scientific and technological public activities according to the provisions of law.
9. Collect, pay, manage and use fees, charges and other revenues related to standards, measurement and product and goods quality activities according to the provisions of law.
10. Manage the organizational structure, officials, contract labor, finance and assets according to the provisions of law.
11. Perform other tasks assigned by the Department's Director.
